Denial of Questionable Workers Compensation Claim Upheld by Supreme Court

Munson and Shultz Prevail on Appeal to South Dakota Supreme Court

A hotly disputed claim for worker's compensation benefits was resolved favorably for the Employer by the South Dakota Supreme Court.  Claimant Rod Padgett alleged that he slipped and fell while working at the State Game Lodge in Custer, but his immediate supervisor denied the injury occurred.  After a hearing in Rapid City before the South Dakota Department of Labor and Regulation, the Employer's denial of coverage was upheld.  The Sixth Judicial Circuit in Pierre, South Dakota, confirmed the agency's ruling.  Employer and Insurer's position was affirmed by the South Dakota Supreme Court by Order dated September 2, 2014.  Woods Law Firm attorneys Shelly Munson and Jeff Shultz represented the Employer.
